Terms & Conditions

Last updated: January 2025

1. Acceptance of Terms

By engaging the services of Oamaru Panel and Paint ("we", "us", "our"), located in Oamaru, New Zealand, you agree to be bound by these Terms and Conditions. These terms apply to all repair work, quotes, and services provided by Oamaru Panel and Paint.

2. Quotes and Estimates

All quotes provided are estimates based on visible damage assessed at the time of inspection. Additional damage found during the repair process may result in revised costs. We will notify you of any material changes before proceeding with additional work.

3. Authorisation to Proceed

By authorising us to begin repairs (verbally, in writing, or by signing a job card), you confirm you have the legal right to authorise the repair of the vehicle and accept responsibility for the agreed costs.

4. Insurance Claims

Where work is to be covered by an insurance policy, the vehicle owner remains responsible for payment if the insurer declines or partially declines the claim. We are not responsible for the outcome of insurance assessments or disputes between you and your insurer.

5. Payment Terms

Payment is due upon collection of the vehicle unless a credit account or insurance arrangement has been agreed in advance. We accept cash, EFTPOS, and bank transfer. Vehicles will not be released until payment is received in full.

Outstanding accounts may incur interest at a rate of 2% per month on overdue amounts. Recovery costs associated with debt collection will be passed on to the debtor.

6. Parts and Materials

We use quality OEM or equivalent parts sourced from reputable suppliers. Where you request specific parts (e.g. genuine manufacturer parts), additional costs may apply. We do not accept liability for parts supplied by the customer.

7. Vehicle Collection and Storage

Vehicles must be collected within 5 working days of notification that repairs are complete. Vehicles left beyond this period may incur a storage fee of up to $30 per day. Oamaru Panel and Paint accepts no liability for vehicles left on the premises beyond 30 days.

8. Warranty

We stand behind our workmanship. Repairs carried out by Oamaru Panel and Paint are warranted against defects in workmanship for a period of 12 months from the date of completion. This warranty does not cover damage caused by further accidents, misuse, or normal wear and tear.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law, Oamaru Panel and Paint's total liability for any claim arising out of or relating to our services shall not exceed the amount paid for the specific service giving rise to the claim. We are not liable for any indirect, incidental, or consequential loss.

10. Personal Property

Oamaru Panel and Paint takes reasonable care of vehicles in our possession. However, we are not responsible for personal items left in vehicles. Please remove all valuables before leaving your vehicle with us.

11. Dispute Resolution

If you have a complaint, please contact us directly first. We are committed to resolving disputes fairly and promptly. If an issue cannot be resolved directly, disputes may be referred to the Motor Trade Association or relevant New Zealand dispute resolution services.

12. Governing Law

These terms are governed by and construed in accordance with the laws of New Zealand. The Consumer Guarantees Act 1993 and Fair Trading Act 1986 apply where relevant and cannot be excluded.
